Terms of use

These terms are an agreement between you and Karman62 LLC (“we”, “us”) about your use of the Habitot app and this website. By downloading or using Habitot, you agree to them. If you don’t agree, please don’t use Habitot.

The App Store license

Your license to use the Habitot app is granted under Apple’s Licensed Application End User License Agreement (the “Standard EULA”). These terms add the rules for playing Habitot and using our service. If something in these terms conflicts with the Standard EULA, the Standard EULA applies to your license to the app.

Who can use Habitot

You must be at least 13 years old to use Habitot. If you’re under the age of legal adulthood where you live, you need a parent or guardian to agree to these terms for you.

Your account

• You sign in with an email code, Sign in with Apple or Google. Keep access to that email or account secure, because anyone who can sign in to it can use your Habitot account.
• An account is for one person and one pet journey. Don’t share it, sell it or sign in as someone else.
• Tell us at [email protected] if you think someone else has used your account.

Health and safety

Habitot is a game that rewards healthy habits. It is not medical advice, a medical device, or a substitute for a doctor, dietitian or coach.

• Check with a doctor before starting a new exercise routine, especially if you have a health condition, are pregnant, or haven’t exercised in a while.
• Stop exercising and get help if you feel pain, dizziness, shortness of breath or anything that worries you. Your pet would rather you rest.
• If you’re pregnant or need lighter exercise, turn on a gentle mode in the app.
• Meal Fuel scores, tips and heart-rate zones are automated estimates made for the game. They aren’t nutrition or medical guidance and may be wrong. If you have, or have had, a difficult relationship with food, you can turn meal scoring off in the Me tab.
• Never use Habitot in an emergency. Contact your local emergency services instead.

Subscriptions and the free trial

Habitot is free to set up. Playing beyond setup needs a Habitot subscription.

• Free trial. New players get a 7-day free trial, which starts when your egg hatches. If you don’t cancel at least 24 hours before the trial ends, your subscription starts automatically and you’re charged.
• Payment. Payment is charged to your Apple ID account when the trial ends, or when you confirm the purchase if you aren’t eligible for a trial. Prices are shown in the app before you subscribe and may vary by country.
• Automatic renewal. The subscription renews every month unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for the renewal within the 24 hours before the current period ends.
• Managing and canceling. Manage or cancel your subscription in iPhone Settings › your name › Subscriptions. Deleting the app or your Habitot account doesn’t cancel your subscription.
• Refunds. Purchases are made through Apple, so refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com.
• Price changes. If the price changes, Apple will tell you in advance, and where required, ask for your consent before you’re charged the new price.
• If your subscription ends. Your pet waits for you with its stats frozen. Subscribe again and it starts a comeback quest to come home.

Fair play

Habitot works because progress is earned. You agree not to:

• fake, spoof or tamper with health data, sensors, photos or the app’s verification, for example with devices that simulate movement or with reused or edited photos;
• use bots, scripts or modified versions of the app, or reverse engineer, copy or resell the app or its art;
• disrupt the service, get around its limits, or access other players’ data;
• use Habitot in a way that breaks the law or harms other people.

To keep things fair, unusual activity may be held for review before it counts, and we may remove progress that was gained by breaking these rules.

Your photos and content

You keep ownership of the photos you take in Habitot and anything else you submit, such as a request to rescore a meal. You give us permission to store, process and analyze that content only to run Habitot for you, including sending meal and water photos to our AI provider for scoring, as described in the privacy policy. Only photograph your own meals and drinks, and don’t capture other people without their permission.

Your pet and virtual items

Your pet, its stats, items and other in-game progress are part of the game. They have no cash value, can’t be sold or transferred, and aren’t your property. We may rebalance the game, for example by changing how stats are earned, to keep it fun and fair.

Our content

The Habitot name, logo, characters, art, writing and software belong to us or our licensors and are protected by intellectual property laws. You may share screenshots of your own pet for personal, non-commercial use.

Changes to Habitot

We keep improving Habitot, so features may change, be added or be removed. We work to keep the service running, but it may sometimes be unavailable. If we ever shut Habitot down, we’ll give you reasonable notice in the app.

Ending your use

You can stop using Habitot at any time and delete your account in the app at Me › Delete account. We may suspend or close an account that seriously or repeatedly breaks these terms. Where possible, we’ll tell you why first.

Disclaimers

Habitot is provided “as is” and “as available”. To the extent the law allows, we don’t promise that it will be error-free or uninterrupted, or that any score, estimate or result will be accurate. Nothing in these terms limits rights you have under consumer protection laws that can’t be waived.

Limitation of liability

To the extent the law allows, we’re not liable for any indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill, arising from your use of Habitot. Our total liability for any claim about Habitot is limited to the amount you paid for Habitot in the 12 months before the claim. Some places don’t allow these limits, so they may not apply to you.

Governing law

These terms are governed by the laws of the place where Karman62 LLC is established, without regard to its conflict-of-law rules. If you use Habitot as a consumer, you also keep the protection of any mandatory laws of the country where you live.

Changes to these terms

We may update these terms from time to time. We’ll change the date at the top of this page and, for important changes, tell you in the app before they take effect. If you keep using Habitot after a change takes effect, you accept the new terms.
